Terms of Service

1. Who we are

NRJ Boost Motion (motiondesign.nrjboost.fr) is operated by NR DIGITAL BOOST, a French simplified joint-stock company (SAS) with a share capital of €1,000, registered office at 72 boulevard des Coteaux, 92500 Rueil-Malmaison, France, registered with the Nanterre Trade and Companies Register under number 953 176 815, EU VAT number FR42953176815 (the “Provider”). 2. Scope

These terms apply to any order placed with the Provider (by the “Client”) on the English-language website (motiondesign.nrjboost.fr/en) or through a payment link sent by the Provider. By checking the box when ordering, or by paying a payment link that refers to these terms, the Client accepts them in full. The Client orders for the needs of its business.

3. Services

The Provider produces motion design video ads according to the pack chosen, as described on the website on the day of the order:

  • Social Ads Starter ($447): 1 core video of about 25 seconds and 4 hooks of about 5 seconds, in 1:1 and 9:16 formats, i.e. 8 files;
  • Social Ads Power ($687): 2 core videos of about 25 seconds and 8 hooks of about 5 seconds, in 1:1 and 9:16 formats, i.e. 16 files;
  • Social Ads Premium ($1,087): 3 core videos of about 25 seconds and 12 hooks of about 5 seconds, in 1:1 and 9:16 formats, i.e. 24 files;

Each pack includes scriptwriting, animation, an American English voiceover, music and sound design, captions when the format requires them, launch support (advice on going live, starting budget and reading results), and the revisions described in section 6. Add-ons (extra hook $57, extra language $197, Turbo 24h $347) are billed separately at the prices shown.

The Provider freely organizes the production: methods, software, tools and contributors. It commits to the result described in the pack and in the script approved by the Client, not to a particular production method.

4. Prices and payment

Prices are in US dollars. French VAT does not apply to services supplied to businesses established outside the European Union (article 259-1 of the French Tax Code); any local sales or use taxes are the Client's responsibility. The price is payable in full, in one payment, by card or Apple Pay through a secure payment link (processed by Mollie on behalf of the Provider's bank, Qonto): the link either opens on the website when the order is placed, or is emailed to the Client. Add-ons chosen after the order are paid through an additional link; nothing is charged without the Client's consent.

An invoice is issued in the Client's name. Production, and the timeline in section 5, start upon receipt of payment.

5. Brief and timeline

The Client provides a written brief (business, offer, audience, wishes) when ordering or afterwards. Without a detailed brief, in particular with “carte blanche”, the Provider relies on the Client's website and public information, including its past ads in the Meta Ad Library.

The first cut of the core video is delivered within 3 business days (French business days) of receipt of payment and of the Client's approval of the script. The script is submitted to the Client before animation; the timeline is paused while awaiting approval. Hooks and the second format are delivered within 48 business hours of the Client's approval of the core video.

6. Unlimited revisions

The Client may request changes with no limit on number to the text, pacing, colors, visuals, voice and music, as long as the subject and the angle defined in the brief and the approved script remain the same. A change of subject, offer or angle is a new order. Feedback is sent in writing (email or WhatsApp); each round is handled within an indicative 2 business days.

Without feedback from the Client within 30 days of the delivery of a version, the video is deemed accepted and the service completed.

7. “Power back on” guarantee: remade or refunded

If the Client is not satisfied with the first cut, it may request in writing within 7 days of delivery that it be remade from scratch: the Provider then delivers a new version on the same brief within the timeline of section 5. If the Client is still not satisfied, it may request in writing within 7 days of that delivery a full refund of the order, made within 14 days to the original payment method.

Until the video is approved, each version is shown as a watermarked preview. Once the Client approves the video and the Provider delivers the final files without watermark, the service is fully performed and no refund is possible. A refunded video may not be published or used: its final files are not delivered and no rights are granted (section 8). The guarantee applies once per order, to the packs presented on the website; it does not apply to add-ons alone or to a change of subject or offer.

8. Delivery and ownership

Final videos are delivered as high-definition MP4 files through a download link. Upon full payment, the Provider grants the Client, worldwide and for the full legal duration of copyright, the rights to reproduce, display and adapt the videos on all digital media, including paid advertising (non-exclusive for generic elements, exclusive for the final video as a work). Broadcast on TV or in cinemas requires a separate agreement. Working files are not provided.

Each video is an original creation made specifically for the Client, except for elements used under license (music, fonts, stock images or sounds). The Client warrants that it holds the rights to the elements it provides (logo, trademarks, images, texts). The Provider may show the video in its portfolio unless the Client objects in writing, free of charge and without justification.

9. Content and liability

The Client remains responsible for the claims made in the video (prices, performance, offer terms) and for their compliance with the rules that apply to its business, including advertising platform policies. The Provider has an obligation of means, not of result, regarding the commercial results obtained with the video. Its total liability, for any cause, is limited to the amount paid for the order concerned.

11. Governing law and disputes

These terms are governed by French law. In case of dispute, the parties first seek an amicable solution; failing that, the Commercial Court of Nanterre (France) has exclusive jurisdiction. If these terms are translated, the English version prevails for orders placed on the English-language website.
